1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Mark Thompson, doing business as TripDasher ("Company," "we," "us," or "our"), concerning your access to and use of the TripDasher mobile application. By accessing the App, you agree that you have read, understood, and agreed to be bound by all of these Terms.

2. Subscriptions and Payments

TripDasher offers premium features via auto-renewing subscriptions (monthly or annually).

• Payments will be charged to your Apple or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• We do not process refunds directly; all refund requests must be handled through Apple or Google's respective app store policies.

3. Artificial Intelligence and Visa Estimates

TripDasher utilizes AI to help organize your itineraries and estimate travel requirements, including visa needs.

• Not Legal Advice: Visa and travel requirements change rapidly. The information provided by our AI is an estimate and should not be relied upon as legal or official travel advice.
• User Responsibility: You are solely responsible for verifying all gate changes, flight times, and visa requirements with official sources (such as airlines and relevant embassies) prior to travel. We are not liable for missed flights, denied entry, or travel disruptions.

4. Third-Party Links and Affiliates

The App may contain links to third-party websites, such as Viator for tour bookings or airline websites. We are not responsible for the content, accuracy, or privacy practices of these external sites. If you purchase a service through a third-party affiliate link, your agreement is solely with that third party.

5. Limitation of Liability

To the maximum extent permitted by law, in no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the App.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the lesser of:

1. The amount paid, if any, by you to us during the twelve (12) month period prior to any cause of action arising; or
2. $100.00 AUD.

6. Dispute Resolution and Arbitration

If a dispute arises out of or relates to these Terms, the parties agree to first attempt to resolve the dispute informally for at least thirty (30) days before initiating arbitration. If the dispute cannot be resolved informally, it shall be resolved by binding arbitration. The arbitration shall take place in New South Wales, Australia, and shall be governed by the laws of Australia and New South Wales.

7. User Generated Content and Copyright

You retain ownership of the travel documents and itineraries you upload. However, you grant us a license to host and display this content within your private vault. If you believe any content on the App infringes upon your copyright, please contact us immediately so we can remove it.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms.
